This legal notice sets out the general terms and conditions governing access to and use of this website, hereinafter “the Website”. The use of the Website implies the express and full acceptance of these general terms and conditions in the version published at the time the user visits the Website, notwithstanding the particular conditions that may apply to some of the Website’s specific services.

Website use is free of charge, except for the cost of connection through the telecommunications network supplied by the service provider users have contracted. Certain services are exclusive to our clients and access to them is restricted.

All products and services on these pages which are NOT the property of Mobiliario Smart Andalucía, S.L. are registered trademarks of their respective owners and are recognised as such by our company. They only appear on the Mobiliario Smart Andalucía, S.L. Website for promotional and information gathering purposes. These owners may request the modification or elimination of the information that belongs to them.

3.1 General

The User agrees to correctly use the Website in compliance with the law and this Legal Notice. The User will be liable to Mobiliario Smart Andalucía, S.L. or to third parties for any damages that may be caused as a result of non-compliance with this obligation.

4.1 Information

Mobiliario Smart Andalucía, S.L. accepts no liability for decisions made based on the information provided on the Website or for any damages caused to the User or third parties as a result of actions based solely on the information obtained on the Website.

4.2 Service quality

Using the Website does not imply any obligation on the part of Mobiliario Smart Andalucía, S.L. to check for the absence of viruses, spyware or any other harmful element.

Mobiliario Smart Andalucía, S.L. accepts no liability for for any damage caused to the computer equipment of Users or third parties during the provision of the Website service.

Access to the Portal requires the services and provisions of third parties, including transmission through telecommunications networks whose reliability, quality, continuity and operation is not the responsibility of Mobiliario Smart Andalucía, S.L. Consequently, the services provided through the Website may be suspended, cancelled or become inaccessible, prior to or at the same time as the Website service is provided.

Mobiliario Smart Andalucía, S.L. accepts no liability for damages of any kind caused to the User as a result of breakdowns or disconnections in the telecommunications networks which lead to the suspension, cancellation or interruption of the Website’s service during the provision of the same or prior to the same.

4.4 Content and services linked through the Website

The Website access service includes technical linked devices, directories and even search tools which allow the User to access other internet pages and websites (hereinafter, “Linked Sites”). In these cases, Mobiliario Smart Andalucía, S.L. acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of 12 July, on Information Society Services and Electronic Commerce (LSSI for its acronym in Spanish) and will only be responsible for the content and services supplied on the Linked Sites to the extent that it has effective knowledge of the illegal nature of the link and has not removed it with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, he/she can notify Mobiliario Smart Andalucía, S.L. in accordance with the procedure and effects established in Clause 6, without this notification implying in any case the obligation to remove the corresponding link.

Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with the managers or owners of the same, nor the recommendation, promotion or identification of Mobiliario Smart Andalucía, S.L. with the statements, contents or services provided.

Mobiliario Smart Andalucía, S.L. has no knowledge of the content and services of the Linked Sites and therefore accepts no liability for any damage caused by the unlawfulness, quality, failure to update, unavailability, error or uselessness of the content and/or services of the Linked Sites or for any other damage which is not directly attributable to Mobiliario Smart Andalucía, S.L..

6. Notification of illegal and inappropriate activities.

In the event that the User or any other internet user becomes aware that the Linked Sites refer to pages whose content or services are unlawful, harmful, denigrating, violent or against public morals, he/she may contact Mobiliario Smart Andalucía, S.L., indicating the following:

Personal data of the communicating party: name, address, telephone number and email address
Description of the facts that attest to the illicit or inappropriate nature of the Linked Site
In the event of violation of rights, such as intellectual and industrial property, the personal details of the holder of the infringed right when this is a person other than the communicating party.

Receipt by Mobiliario Smart Andalucía, S.L. of the communication provided for in this clause does not imply, in accordance with the provisions of the LSSI, effective knowledge of the activities and/or contents indicated by the communicating party.

Likewise, the document accrediting the legitimacy of the holder of the rights must be provided and, where applicable, that of a representative acting on behalf of the holder when he/she is a person other than the communicating party.

All notifications and communications made by the parties will be valid in accordance with the means permitted by law. Those relating to this Website will be considered effective, for all purposes, if they are made through the Website itself.

8. Modifications

Mobiliario Smart Andalucía, S.L. reserves the right to make any modifications it deems appropriate to its website without prior notice, and may change, delete or add both the content and services provided through the Website and the way in which they are presented.

Additionally, these Terms and Conditions may change at any time. The modifications will enter into force from the moment of their publication.

Mobiliario Smart Andalucía, S.L. has a presence on several social media sites and platforms, and therefore, when accessing any of these or other social media sites, please remember that the applicable terms and conditions of use are those established by each platform, in which Mobiliario Smart Andalucía, S.L. does not intervene.

10. Legislation

This Legal Notice is governed in each and every one of its aspects by Spanish law. Provided that the applicable law allows the waiver of the established legal jurisdiction, the courts of Málaga are designated as the jurisdiction to settle possible disputes, the user expressly waiving any other jurisdiction that may apply.

ITABLE PROJECT

An incentive has been received from the Andalusian Regional Government’s Agency for Innovation and Development of Andalusia (IDEA) for an amount of €26,354.23, co-financed 80% by the European Union through the European Regional Development Fund (ERDF) for the implementation of the design and development of an autonomous system of commands from the table (ITABLE) with the aim of “Promoting technological development, innovation and quality research”.
